Kewlshells.com ("KEWLSHELLS") provides internet presence services, including, but not limited to, web
hosting, shell accounts, to its clients ("CLIENT"). KEWLSHELLS general policy is to act as a neutral
provider of these services; however, KEWLSHELLS reserves certain legal and ethical rights.

General Usage
1) Activity that promotes, or participation from KEWLSHELLS account by CLIENT, of denial of service attacks,
is forbidden. 2) Running EGGDROP BOTS on IRC servers that do not allow EGGDROP BOTS is forbidden. 3)
War, XDCC, MECH, and TAKEOVER BOTS are forbidden. 4) Establishing greater than one connection per
process, excluding authorized IRCD processes, is forbidden. 5) Running WEBCAMS, SHOUTCAST SERVERS,
any type of GAME SERVER, or any other process that utilizes an unreasonable amount of bandwidth or
system resources, is forbidden.

Server Usage
KEWLSHELLS account is to be used by primary CLIENT only. CLIENT is responsible for activity in CLIENT
account. CLIENT may not resell, trade, or give away access to account, without expressed permission
from KEWLSHELLS.

Unauthorized Usage
KEWLSHELLS will strongly react to any use or attempted use of KEWLSHELLS account for password cracking,
security
hole scanning, storage of copyrighted or pirated material, etc. Any unauthorized use, whether or not
the attacked account or computer belongs to KEWLSHELLS, will result in action against the attacker.
In addition to possible account suspension or cancellation, any and all Unauthorized Usage by CLIENT is
systematically reported to authorities, in accordance with established laws.

Commercial Advertisements/Unsolicited E-mail
Unsolicited commercial advertisements are not allowed by CLIENT, and will result in swift corrective
action, at discretion of KEWLSHELLS.

Payment Policies
Payments are due on the first day of every month.
We will do our best to send CLIENT an email as a reminder with information on how to make a payment.
KEWLSHELLS will temporarily close CLIENT account if payment isnt recieved within 7 days after payment due
date.
KEWLSHELLS will permanently close CLIENT account if payment isnt recieved within 14 days after payment due
date.

Cancellation
KEWLSHELLS reserves the right to, and CLIENT may, for any reason, cancel service at any time, but no refund is
due, because all sales are final.

Indemnification
CLIENT agrees to defend, indemnify, save and hold KEWLSHELLS harmless from any and all demands, liabilities,
losses, costs and claims, that may arise or result from any service provided or performed or agreed to
be performed.
CLIENT agrees to defend, indemnify and hold harmless KEWLSHELLS against liabilities arising from: (1) any
injury to person or property caused by any products sold or otherwise distributed in connection with
KEWLSHELLS servers; (2) any material supplied by CLIENT infringing or allegedly infringing on the
proprietary
rights of a third party; (3) copyright infringement; (4) any defective products sold to CLIENT from
KEWLSHELLS servers.

KEWLSHELLS will not be responsible for any damages CLIENT may suffer. KEWLSHELLS makes no warranties of any kind,
expressed or implied, for services provided. KEWLSHELLS disclaims any warranty or merchantability or fitness
for a particular purpose. This includes uptime, loss of data resulting from delays, nondeliveries, wrong
delivery, and any and all service interruptions caused by KEWLSHELLS.
KEWLSHELLS will not be responsible for lost data of the CLIENT on any KEWLSHELLS server(s) . KEWLSHELLS makes no
warranties of any kind, expressed or implied, for CLIENT data.
